This document (“Information”) has been drawn up to allow you to understand how your Personal Data, as defined below, will be processed when using the Site. The Policy is intended to provide you with the information necessary for you to express your explicit and informed consent to the processing carried out through the Site, if you deem it appropriate.

1. Data Controller and Data Protection Officer
EMA BART, as identified at the beginning of this Privacy Policy, is the Data Controller for all Personal Data processed through the Site and can be contacted at the following address: info@emabartfirenze.it

2. The personal data subject to processing
Following your navigation of the Site, we inform you that EMA BART will process your Personal Data, which may consist of – also depending on your decisions on how to use the Services – an identifier such as your name and surname, an online identifier or one or more characteristic elements of your physical, physiological, psychological, economic, cultural or social identity suitable to make you identified or identifiable (hereinafter only "Personal Data”).
Your Personal Data may be collected either because you voluntarily provide it (e.g., to receive the Services offered) or simply by analyzing your behavior on the Site.
The Personal Data processed through the Site are the following:

a. Name, contact details and other Personal Data

In the section of the Site relating to the creation of a personal account, you will be asked to enter information such as your name, surname, telephone number, email address, country of residence, delivery address and, if different, billing address.
While using the Services, you may also be asked to enter information relating to your payment methods, such as PayPal or credit card.

b. Special categories of personal data

Some sections of the Site (e.g., “contacts”) include free fields where you can provide certain information, which may contain Personal Data.
Since these fields are free, you may use them to communicate (voluntarily or not) certain sensitive categories of Personal Data, such as data revealing racial or ethnic origin, genetic data, biometric data intended to uniquely identify a natural person, data concerning health or data concerning a person's sex life or sexual orientation.
We ask you not to submit such Personal Data unless strictly necessary. Indeed, these special categories of Personal Data may be processed only with your explicit consent (which can be expressed by ticking the appropriate box on the data collection screen) and in compliance with applicable legislation.

c. Data provided voluntarily by the interested party

As mentioned above, in some parts of the Site (such as when, purchasing a product on the Site, you wish to include a message, such as "best wishes" attached to the product shipment), you may be allowed to enter text messages, visible to the owner, which may contain Personal Data of other people.
In such cases, you assume the role of independent data controller, assuming all legal obligations and responsibilities. In this regard, you hereby fully indemnify us against any dispute, claim, or request for compensation for damages arising from processing, etc., that may arise from third parties whose Personal Data has been processed through your use of the Site's functions in violation of applicable data protection laws. In any case, if you provide or otherwise process Personal Data of third parties while using the Site, you hereby guarantee – assuming all related liability – that such particular processing is based on the consent of such interested third party or on another appropriate legal basis that legitimises the processing of the information in question.

d. Browsing data

The computer systems and software procedures used to operate the Site acquire, during their normal operation, some Personal Data whose transmission is implicit in the use of Internet communication protocols. This information is not collected to be associated with identified data subjects, but by its very nature could, through processing and association with data held by third parties, allow users to be identified. This category of data includes the IP addresses or domain names of computers used by users connecting to the Site, the URI (Uniform Resource Identifier) addresses of requested resources, the time of the request, the method used to submit the request to the server, the size of the file obtained in response, and the numerical code indicating the status of the server response (successful, error, etc.).) and other parameters relating to the user's operating system and IT environment. This data is used solely to obtain anonymous statistical information on the use of the Site and to monitor its proper functioning, identify anomalies and/or abuse, and is deleted immediately after processing. 4. Legal basis and mandatory or optional nature of the processing
The legal bases used by EMA BART to process your Data, according to the purposes indicated in the previous Paragraph 3, are as follows:

• Provision of the ServiceProcessing for this purpose is necessary to provide you with the Services and, therefore, to perform the contract with you. It is not mandatory to provide EMA BART with your Personal Data for this purpose, but otherwise, it will not be possible to provide you with any Services. The same applies to the newsletter service, which arises from your specific request by entering an email address. You can unsubscribe at any time by following the instructions in Section 7 of this Policy.

• Soft Spam: processing for this purpose is based on EMA BART's interest in sending you marketing communications via email regarding products and services similar to those you have already purchased through the Site. You can stop receiving these communications, without any consequences for you (other than the fact that you will no longer receive further communications of this kind from EMA BART) by using the link at the bottom of each of these emails;

• ComplianceProcessing for this purpose is necessary for EMA BART to fulfill any legal obligations. 5. Recipients of personal data
Your Personal Data may be shared with the parties listed below (the “Recipients”):

• subjects with whom it is necessary to interact for the provision of the Services (for example hosting providers or suppliers of platforms for sending emails);
• persons delegated to carry out technical maintenance activities (including maintenance of network equipment and electronic communications networks);
• persons authorised by EMA BART to process Personal Data necessary to carry out activities strictly related to the provision of the Services, who have undertaken to maintain confidentiality or have an adequate obligation legal confidentiality (e.g. EMA BART employees);
• subjects, entities or authorities to whom it is mandatory to communicate your Personal Data for Compliance, Abuse or Fraud purposes, or by order of the authorities;

6. Retention of Personal Data
Personal Data processed for the purpose of Provision of Services They will be retained by EMA BART for the time strictly necessary for the aforementioned purpose (e.g., to send the purchased product). In any case, since such Personal Data is processed to provide you with the Services, EMA BART may retain them for a longer period, particularly as may be necessary to protect EMA BART's interests from potential complaints relating to the Services.
Personal Data processed for the purpose of Soft Spam will be stored by EMA BART until you object to such processing through the link found at the bottom of each of the emails. Soft Spam.

Personal Data processed for the purpose of Compliance will be retained by EMA BART for the period required by specific legal obligations or applicable regulations.

Personal Data processed for the purpose of preventing Abuse/Fraud will be retained by EMA BART for the time strictly necessary for the aforementioned purpose and therefore until the moment in which EMA BART is required to retain them to protect itself in court or communicate said data to the competent Authorities.

7. Rights of the interested party
You have the right to ask EMA BART, at any time:

  • access to your Personal Data (or a copy of such Personal Data), as well as further information on the processing being carried out on them;
  • the rectification or updating of your Personal Data processed, where they are incomplete or out of date;
  • the deletion of your Personal Data from the databases;
  • the limitation of the processing of your Personal Data;
  • to obtain the Personal Data concerning you in a structured, commonly used and machine-readable format;

as well as you can:

  • object to the processing of your Personal Data by EMA BART (e.g. Soft Spam);

You will be able to stop receiving Soft Spam Using the appropriate link at the bottom of each email you receive. You can also use the same method to unsubscribe from the EMA BART newsletter if you have requested it as a Service.

In any case, you always have the right to lodge a complaint with the competent Supervisory Authority (Data Protection Authority) if you believe that the processing of your Personal Data violates applicable law.

8. Changes
This privacy policy is effective as of March 24, 2018. EMA BART reserves the right to modify or simply update its content, in part or in full, including due to changes in applicable legislation. EMA BART will inform you of such changes as soon as they are introduced, and they will be binding as soon as they are published on the Site. EMA BART therefore invites you to visit this section regularly to review the most recent and updated version of the privacy policy so that you are always informed about the data collected and how it is used.
